Owls Hosting

This agreement with Owl's Hosting identifies and establishes the terms of service. Under this document, Owl's Hosting services are all established in accordance to our terms. Owl's Hosting may change this document at any given time, for any reason at all, for as often as deemed necessary. Under these terms, there are the following sections:

1. SERVICE - Owl's Hosting provides web hosting services either through shared accounts. Our servers are used to store data, particularly “Web Sites”, in order to spread data or information “World Wide”. Therefore the use of our services provided by you, the “Customer”, is your complete risk. Owl's Hosting, DENIES AND REJECTS ANY RESPONSIBILITY HELD FOR THE DATA SENT OUT.

2. NO WARRANTIES OF SERVICE - Owl's Hosting makes an attempt to bring you the best quality possible with our services, however in the event that is not possible, WE HAVE NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THAT FOR A PARTICULAR PURPOSE. Owl's Hosting is UNABLE TO GUARANTEE PERFECT SERVICE, INCLUDING THE INTEGRITY OF ANY DATA STORED OR TRANSMITTED VIA THE INTERNET OR THROUGH OUR SYSTEMS. Owl's Hosting is NOT LIABLE FOR ANY CLAIMS OF DAMAGE BY THE CUSTOMER, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF EVERY NATURE, CAUSED BY THE LOSS OF DATA, OR THROUGH THE INABILITY TO CONNECT TO THE INTERNET, OR THROUGH INABILITY TO SEND AND RECEIVE DATA. THIS INCLUDES BUT NOT LIMITED TO THE HACKING OF YOUR WEBSITE, DELETION OF YOUR ACCOUNT AND ETC, YOU ARE SOLELY RESPONSIBLE FOR MAKING BACKUPS SO THIS CAN BE PREVENTED AS WE ARE NOT RESPONSIBLE FOR THIS.

3. INDEMNIFICATION - Customer shall Indemnify and hold harmless from all demands including, liabilities, costs, claims, liabilities, attorney fees against Owl's Hosting, or any of its affiliates, resellers, other customers, etc. This means that the Customer WILL NOT HOLD US RESPONSIBLE FOR ANY LIABILITIES ARISING OUT OF ANY INJURY TO PEOPLE OR DAMAGE DONE TO PROPERTY CAUSED BY OUR SERVICES, material supplied by Customer who infringes or allegedly infringing a third party. Owl's Hosting IS NOT REQUIRED TO COMPENSATE OR REFUND BY ANY MEANS. WE REFUND ON A CASE BY CASE BASIS ACCORDING TO OUR REFUND POLICY.

4. SERVICE FEES AND BILLING - Owl's Hosting will bill you on a monthly basis with invoices. Our billing period is on the anniversary of the date of the month for that month's service, therefore we will make every possible contact with you to make sure you get properly billed. If you do encounter any service fees such as additional IP addresses, extra space, extra bandwidth, etc. We will put in a separate invoice for you to pay with that amount. Accounts that reach 2 days past due will be suspended and are subject to a late fee of $10.00 and $2.00 a day thereafter which is non-negotiable. If account remains suspended for more than 5 days, we maintain the right to terminate without warning your account off our server(s). Accounts that are not collectible by Owl's Hosting may be turned over to an outside collection agency for collection.

Failure to Pay:
Owl's Hosting may temporarily deny service or terminate this Agreement upon the failure of Subscriber to pay charges when due. Such termination or denial will not relieve Subscriber of responsibility for the payment of all accrued charges, plus any collection/late fees.

5. REFUNDS POLICY - We offer a 7 day money back guarantee on all shared plans. Owl's Hosting will not issue refunds to users who have their account terminated/suspended by Owl's Hosting, for breach of our terms of service/Acceptable Use Policy. Refunds will not be made to users who exceed their allocated bandwidth/space limit. Refunds will not be made after the 7 day money back limit. Accounts that are renewed for additional terms are also not subject to our money back guarantees. REFUNDS ARE GIVEN ON A CASE BY CASE BASIS SO IT MAY TAKE UP TO TWO FULL WEEKS (some cases longer) FOR A REFUND TO BE PROCESSED. We also do not refund the following:

Overage
Late Fees
Violating TOS/AUP

6: Account Cancellation - Requests for cancelling accounts may be through the support system.

**Please note that treating the staff in ANY way disrespectful will result in termination immediately and WITHOUT refund. With this in place we refuse the right to keep your data on the server any longer.

What is allowed and what isn't allowed:

You must have at least 1 active account with Owl's Hosting on the server . If you do not have a website up with 20 days of account setup, we have the right to terminate your account due to inactivity this includes those who do not have any index page and/or is showing a parent directory. No exceptions!

Illegal Adult content
Rapidleech
Hack Sites Et cetera
File hosting
Proxy
IRC Bots/chats
Torrent
Spamming
Harassment
Threats
Free Hosting/Free reseller hosting
Anything else we see/feel that is of illegal nature

*Note: Owl's Hosting is not responsible for any data loss. Its your responsibility to backup your files, etc.

**Note: Owl's Hosting is not responsible for any hacking of your site and/or deletion of your account off our server (s). Its your responsibility to protect/secure your site.

***Note: Owl's Hosting has the right to change, modify this agreement without notice at anytime.

***Note: Owl's Hosting has the right to suspend or terminate (at our discretion) any accounts that violate the Terms of Service/Acceptable Use Policy.

It is your sole responsibility to read our terms of service and acceptable use policy, you agree to these terms immediately once you are hosted by owls-hosting.com.

Acceptable Use Policy (AUP)

1. MASSIVE E-MAIL - You are not allowed to use our services to send out or solicit /mass e-mails to users on a bulk e-mail address list at which no users were opt in. This is considered SPAM and will not be tolerated. Your account will be subject to suspension and/or termination.

2. ADULT CONTENT - Owl's Hosting allows for adult content to be hosted on our servers. We do not have any problems with it, so as long as its not illegal, and you have the proper notification on your site that makes it comply with US laws.

3. RELAY FOR E-MAIL - We prohibit the usage of our servers for relaying of electronic mail.

4. RESOURCE USAGE - We allow up to 20% maximum CPU and/or RAM Usage for no more than sustained time of 4 minutes. Your account will then be suspended and you will be notified with a suspended page in which you must contact us to discuss the issue in order to help you reduce this.

5. SECURITY - It is your responsibility to make sure your sites are secure and that you are using the latest up to date scripts to prevent your sites from being hacked. If you attempt to use our services to actively hack others, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY AND A REPORT WILL BE FILED WITH THE APPROPRIATE AUTHORITIES AND WITHOUT REFUND!

6. ILLEGAL USAGE - Owl's Hosting prohibits the usage of torrent flux, rapid leech, and other such scripts that deal with file sharing, or the sharing of illegal content including but not limited to hacking websites, scripts and et cetera. If your account holds any illegal files, and we get a report about it, you will automatically be terminated with no exceptions.

7. PROXIES AND TOPSITES - You are not allowed to have proxies and/or top sites on your account. Your account will be suspended if we find such things. Top Sites are high in CPU and RAM usage. Proxies are generally high in RAM usage, therefore we do not allow them for the sake of other customers unless otherwise given permission by owls-hosting.com Administration only!

8. PRIVACY - Your information is kept private and is encrypted for your protection to prevent any unauthorized access out of the way. We will never sell your information to any third party.
